Our band is gonna sign one. I'm thinkin of registering with ascap as a writer too.
I sorta get it, just curious what y'all have done in ur pasts.
We're workin with Ron Bienstock (apparently some muckity-muck )

"Intra band agreement." Is that sorta like a pre-nup? What are you agreeing to? Do the various band members have different statuses? Different pay grades? Shares of royalties? Some are full band members, but others are hired guns? Seems to me I read that Richard Wright was never a full member of Pink Floyd... But he'd get paid for playing the shows even if the tour lost money.
In my bands we never had anything like that. We would basically have a gentlemen's agreement. Basically, if you quit the band, you gave up your share of whatever equipment we bought as a band, but if the others decide to get rid of you, you deserve some repayment

Bienstock, yea, a small festival, I think where Stillsby, Crills, Yash & Noung did their first gig.
Yes, it is sort of a prenup for bands.
Is the band transitioning to original material? Is the band planning a tour? Has the original material already been recorded? Does the band have some solid opportunities for song placement, an album deal, a publishing deal? Who's doing the writing, the whole band as a unit or are there writers bringing songs and then the band arranging them? Does the band collectively own the PA, recording gear?
These kind of agreements are available without the need to pay an attorney. If the attorney is well connected AND wants to pitch your material/band that may be a decent reason to get into a relationship. If you are going to be navigating in areas where there could easily be problems, that's another reason to get some professional help, at least getting opinions on whether something more official might need to be drafted.
Most of these Intra agreements come down to a few areas to cover: -makings lot of money, how might that distributed? Or, lose a lot of money, who shoulders that. Who “owns” the band name? Who gets up credit for songs under what divisions & percentages? Copyrights Who owns the shared assets, like the PA or recording stuffs, or van.
I'm wary of pie in the sky sales pitches from "industry big wigs" . First of all, nobody is signing middle aged bands or artists. There are probably a zillion better songs than mine. Anything requiring pay before results, praying on our "we're gonna get signed" dreams usually means no results and a lighter wallet.

Affiliating with BMI or ASCAP is a good idea if original material or song tracks are being submitted to the industry: Music Supervisors, for placements, publishing companies or labels. I've been with BMI since 1980-something. I list all my tracks with them, who is the writer, who splits the publishing.
I can log on to see my uses, what checks may be coming, update my catalog... They also have a lot of resources and information that one can take advantage of, like songwriter clinics, business advice, concerts, etc. I've been getting quarterly checks since 2000 for TV placements...that have been shrinking yearly primarily because I have not put any effort into getting more music to Supes..

Yes. We're getting Serius xm (soul chammel) and terrestrial radio play. Plus the guy is working to get us in with Orchard Publishing (whatever that is)

Both. I haven't contributed writing yet, but I intend to.

Yes, that's covered. The writer gets payment, the performers get payment.
I'm reading the doc and don't really have any qualms. Of course, I don't know what to have qualms over, hence this thread.

I was in a major band when I was young, a 9 piece soul group that got a recdording contract and big gigs.
I so wish we had on of these. We all invested in band gear and when someone left, got no return. The leader decided on how our money was spent, buyng himself a drum set with group money, much advertising, and taking "exposure gigs."
I wrote tunes, did all the arranging, and got nothing for it.
Good luck and do it right!

Here's the sound exchange info:
SoundExchange https://www.soundexchange.com/ covers artist royalties for "featured artists", specifically for when a song is played on Sirius/XM. Everyone who is in the band who played on the recording is considered a "featured artist". In order to get paid from Sound Exchange, everyone in the band needs to register for their own separate Sound Exchange account. For example, when LoveShine is played on SiriusXM, a royalty is paid to SoundExchange, and then they distribute that payment equally 8 ways -between the 8 band members who played on the recording. In this same manner, anytime a copy of the recording is sold, in the form of CD, vinyl, iTunes, Amazon, etc. the proceeds from those sales will be distributed between the 8 members, in the same way we've already been doing CD sales at the gigs. This happens AFTER recording costs have been recovered. This is fundamentally different than writing/publishing income. That's why writing/publishing income is distributed directly to the writers/publishers.
